The Director General of WIPO, Mr. Francis Gurry, said today that the copyright should evolve to suit the current technological reality, or they will lose relevance.

The Director General stated that there are three principles that should govern the evolution of copyright law. The first is" to be neutral to technology and operational models have emerged to adapt to it. "He said the goal of copyright is not to influence the technical possibilities of creative expression or on business models that emerge from these technical possibilities, or to preserve business models created by obsolete technology. "Their goal is ... to serve each and every one of the techniques of production and distribution cultural works and extract value from the exchanges that these techniques make it possible to arrive at the creators and artists as well as business partners who have been hired to facilitate cultural exchange through the use of technology. The copyright must be an incentive for cultural dynamism, instead of protecting vested interests. "
The second principle, he added, is" completeness and consistency in the policy response. "Mr. Gurry acknowledged that the legislation is limited to half in providing a comprehensive response and noted that "the infrastructure is one aspect of the solution as important as legislation. "In this regard, said that collecting societies" must be different and adapt "because their infrastructure is outdated and" represent a world of separate territories in which rights holders used different means to express their creativity, as opposed to multijurisdictional Internet world in which the expression comes into existence thanks to digital technology. " "We need a global infrastructure that enables the global licensing of exploitation of cultural works, simply and legal on the Internet, as easy as the illegal acquisition of these works on the Internet" Mr. Gurry said. In this regard, said that "an international music record - that is, a global database with all codes - would be a valuable and necessary step towards establishing the infrastructure of global licensing. Also , so that this venture is successful, the future global information infrastructure must work with existing collecting societies rather than replace them. "
Internet culture must also be taken into account. Referring to the high rates of illegal dumping, Mr. Gurry said "to change a course of action, I am convinced that we must rephrase the question that people make about copyright and the Internet. People do not react well if they are branded as pirates. In my opinion, yes react well if they are faced with the challenge of sharing responsibility form a cultural policy. We should refer less to talk about piracy, however, the danger posed to the financial viability of the culture in the XXI century, since that's what we do is at risk if we fail to make effective and balanced policy on copyright.
The third principle that should govern the evolution of copyright law is the need for the copyright is simpler. Mr. Gurry said "Copyright is complicated and complex as it reflects the successive waves of technological development that have affected both the means used for creative expression, from print to digital technology, such as how they have adapted to trading partners such different media, "adding that" we risk losing public support if we fail to understand this system better.
